XBV B.V. (XBV) Privacy Statement
Through the online game Plan-it Commander, privacy-sensitive data and/or personal data are processed. XBV considers the careful handling of personal data of great importance, thus personal data is therefore carefully processed and secured to best of our ability.
In our data processing practice, we comply with the requirements set by the privacy legislation. That means, among other things, that:
• we clearly state the purposes for which we process personal data. We do this via this privacy statement;
• we limit the collection of personal data to data necessary for legitimate purposes ;
• we first ask users for explicit permission to process personal data in cases where consent is required;
• we take appropriate security measures to protect personal data, including when data is exchanged with parties critical to the operations of Plan-It Commander
• we respect users’ rights to provide users with their personal data for inspection, correction, or deletion
XBV is responsible for data processing. In this privacy statement we explain which personal data we collect and use and for what purpose. We advise you to read this carefully.

Use of Personal Data
When accessing the online game Plan-It Commander, XBV obtains certain information from users that may be personal data. We only keep and use the personal data provided by users directly, within the framework of the service requested by the user, or of which it is clear that the user has provided the data to XBV.
We use the following data for the purposes mentioned in this privacy statement:
• NAW data
• Billing address
• E-mail address
• Payment details
• IP address
To access Plan-It Commander, users must register an account. After registration, we save the personal data provided by users via the username the user has chosen or has been assigned. We keep this information so that users do not have to enter their login details every time they play the game, and so that we can communicate with users in the context of the execution of the agreement.
We will not pass on the data linked to our customers’ usernames to third parties, unless it is necessary in the context of the implementation of the agreement or if it is legally required. In case of suspicion of fraud or abuse of our online game, we may hand over personal data to the competent authorities.
When an order it placed by a customer, we use the customer’s personal data for the processing thereof. If necessary for proper processing, we may also provide your personal data to third parties. You can read more about this later in this privacy statement.
We may, in addition to the information on our website, also inform you about our new products and services:

Contact Form and Newsletter
XBV offers a customer service where users may ask questions by means of a contact form or e-mail. By using the form or by sending an e-mail to Plan-It Commander’s support address, customers are requestred to provide informative data which allows XBV’s customer support team to handle any questions/concerns. Customers are responsible for choosing the information in which they provide. This data will be stored safely for as long as the nature of the form or the content of the e-mail is required for the complete answering and processing thereof.
XBV offers a newsletter with the purpose of informing interested parties about our products and/or services. Each newsletter contains a link with which recipients can unsubscribe. Individual e-mail address will only be added to the list of subscribers with the user’s explicit permission.
If necessary for complete service delivery, we may collect location data (GPS) from our users. At this time, user permission will be requested.
This (location) data may also be stored and processed by the provider of, for example, the navigation/map software, such as Google Maps, but the data may also be used by, for example, Google or Apple itself. XBV has no influence or control over the practices of such providers. We recommend that our users read the relevant privacy statements from the relevant provider.
We do not publish our customer data.
Provision to Third Parties
XBV will not provide user data to third parties. These partners are (also) based outside the EU.
What are cookies?
Cookies are small pieces of text sent by your web browser by a website you visit. A cookie file is stored in your web browser and allows the Service or a third-party to recognize you and make your next visit easier and the Service more useful to you. Cookies can be “persistent” or “session” cookies.
We use both session and persistent cookies on the Service and we use different types of cookies to run the Service: Squarespace, Google Analytics, Google Tag Manager.
We may use essential cookies to authenticate users and prevent fraudulent use of user accounts.
XBV has agreements with third parties on the use of the cookies and applications. However, we do not have complete control over what the providers of these applications themselves do with the cookies when they are accessed. Users are free to disable cookies at any time through their browser. Keep in mind however that it is possible that Plan-It Commander’s online website and platform will no longer work optimally.

We use Google Analytics and Google Signal to keep track of how visitors access and utilize Plan-It-Commander. We do this to improve the customer experience, ultimately helping us achieve our mission to empower as many children with ADHD who can benefit. We have signed a processing agreement with Google to make agreements about the handling of our data to ensure safe and ethical data usage. Note that all information gathered is anonymized and used in aggregate. Furthermore, we have not allowed Google to use the obtained analytics for other Google services, and finally we anonymize the IP addresses.

We take security measures to limit abuse of and unauthorized access to personal data.
The personal data described above will be retained for as long as necessary to provide the requested services to our customers. We then store data for a maximum of one year for the statistical purposes described. The data will then be erased unless there is a statutory obligation that requires longer storage (such as the seven-year fiscal retention obligation for payment data).
Third Party Websites
This privacy statement does not apply to third party websites that are connected to our Plan-It Commander by means of links. We can not guarantee that these third parties handle our customers’ personal data in a reliable or secure manner. We encourage users to read the privacy statement of these websites before using them.
Changes to this Privacy Statement
We reserve the right to make changes to this privacy statement. It is advisable to consult this privacy statement regularly so that users are aware of these changes.
Viewing and Changing Personal User Data
Users can also send us a request to view, change or delete this data. Users can also submit a request for us to perform a data export of the data that we use with users’ consent, or they may provide XBV with a motivated statement requesting XBV to limit the processing of personal data.
To prevent abuse, we can users to adequately identify themselves. When it comes to access to personal data linked to a cookie, users must send a copy of the cookie in question. Users can find these in the settings of their browsers. If the details are not correct, users can request that XBV changes the data or have it removed.
Authority of Personal Data
Ofcourse we are happy to help our customers with concerns or complaints about the processing of their personal data. Under the privacy legislation, users also have the right to file a complaint with the Dutch Data Protection Authority against the processing of personal data. Users may contact the Dutch Data Protection Authority for this.
